A man facing two assault charges arising from an incident on William Street has been told to go in the “opposite direction” of the alleged victim if he sees him again.

At Galway District Court, Judge Fiona Lydon granted bail to Dubravko Ostogic (32) on a number of conditions including that he have no contact with the alleged injured party.

Ostogic, of no fixed abode, is charged with assaulting a man on May 12, 2025, at Shop Street, contrary to section 2 of the Non Fatal Offences Against The Person Act.

He is also charged with a breach of the peace public order offence on May 12, 2025 at Eyre Square.

Garda Darren Gibson told the court the accused made no reply to the charges after caution.

Ostogic was previously charged with assault causing harm to the same alleged victim at Shop Street on May 12, contrary to section 3 of the Non Fatal Offences Against The Person Act, as amended.

Garda Gibson said the State objected to the granting of bail on the new Section 2 assault and public order charges.

He said the grounds for objection included the nature and strength of the alleged evidence and that the accused was of no fixed abode.

Of the incident in May, the court heard it will be alleged Ostogic punched the injured party a number of times, causing him to fall and strike the ground.

Garda Gibson confirmed to Judge Lydon that the alleged victim was bleeding from his mouth and lost consciousness for approximately 30 seconds as a result of hitting the ground.

He said the man had not suffered any long term injuries.

Garda Gibson agreed with defence solicitor, John Martin, that his client attended court on the existing section 3 charge and was charged with two new offences.

Mr Martin said his client had secured accommodation in the Ballybrit area and would be willing to abide by conditions set down by the court.

Judge Lydon said she would extend bail from the original charge to cover the new charges.

She said the court noted there was no objection to bail when the accused was first in court on the section 3 assault charge.

After being told of the State’s concern that the parties may “cross paths” in Galway City, Judge Lydon told the accused: “The best thing you could do is go in the opposite direction when you see him”.

Judge Lydon indicated the court would accept jurisdiction to hear the case but wanted confirmation that the injured party did not have any long term problems by the next court date on January 19, 2026.
