A 28-year-old man accused of burglary and trespass offences at a charity shop and a business has been told he must stay out of Sean Mulvoy Park.

Declan Breen, with an address at 28 Fir Domnach Road, Tuam, appeared at Galway District Court on two charges arising rom alleged incidents in November 21.

Breen is charged with entering the Simon Community Shop on Sean Mulvoy Road as a trespasser in circumstances giving rise to a reasonable inference that such entry was with the intention to commit an offence, contrary to section 11 of the Public Order Act.

He is also charged with entering Inner Calm with Gosin, Unit 5B Sean Mulvoy Park, as a trespasser and committing theft.

Detective Garda Mark Kelly told the court he charged the accused at his home address, with two offences.

The court heard that in reply to the trespass charge, Breen said “I’m sorry”.

Detective Kelly said that in reply to the burglary charge, the accused said: “I was taking tablets at the time. I apologise to the injured party and I paid her back €250 before the guards even came”.

Sergeant Claire Heneghan said directions were awaited from the Director of Public Prosecutions on the trial venue for the burglary charge.

Detective Kelly agreed with Judge John King that the trespass charge was likely to be dealt with in the District Court.

The court was told there was no objection to bail subject to conditions.

Declan Breen must reside at his address, observe a curfew and stay out of Sean Mulvoy Park. Judge King remanded him on bail to appear again in court on February 11, 2026.
